Terms and Conditions

Service Agreement: By engaging Peaks Luxury Home Management services, both parties agree to the terms outlined in this contract. The client acknowledges receipt and understanding of the services provided. Scope of Services: Peaks Luxury Home Management will provide comprehensive property management services, including but not limited to weekly home inspections, airport pickups, vehicle airport delivery, private air transportation, home maintenance, vacation preparation, activity planning, and HOA management, as specified in the agreed-upon service package (See checked boxes above). Fees and Payment: Clients are responsible for the fees associated with the selected service package, including any additional costs incurred for specialized services. Payment terms will be agreed upon before the commencement of services. Failure to remit payments may result in service suspension or termination. For any services that are not included in your monthly package price, will be charged to the homeowner with a management fee of cost plus 24%. Price will reflect in the bi-weekly or monthly invoice. Exceptions to this will be any private air travel and vendor management, which will be charged at a cost plus 14%. Duration and Termination: The contract duration is month to month. Either party may terminate this contract with written notice 30 days prior to cancellation, subject to any applicable termination fees outlined in the agreement. Client Responsibilities: Clients are responsible for providing accurate information, access to the property, and necessary approvals for contracted services. Failure to fulfill these responsibilities may impact service and rental volume. Confidentiality: Peaks Luxury Home Management will treat all client information with the utmost confidentiality. Any sensitive information disclosed during the course of service will not be shared with third parties without explicit consent. Liability and Insurance: While Peaks Luxury Home Management exercises due diligence, clients are advised to maintain appropriate insurance coverage for their property. Peaks Luxury Home Management is not liable for any loss, damage, or injury unless resulting from gross negligence. Specific Services and Limitations: a. Weekly Home Inspections: Peaks Luxury Home Management will conduct regular inspections to ensure the property’s security and functionality. However, the client acknowledges that these inspections do not guarantee the detection of all potential issues. b. Airport Pickups and Vehicle Airport Delivery: Peaks Luxury Home Management will facilitate these services but is not liable for delays, changes, or issues arising from external factors such as flight delays, traffic, weather, or unforeseen circumstances. c. Private Air Transportation: Peaks Luxury Home Management will assist in arranging private air transportation but is not responsible for any disruptions, cancellations, or changes made by the air transportation providers. d. Home Maintenance: Peaks Luxury Home Management will coordinate and oversee maintenance tasks but is not liable for the quality or timeliness of services provided by third-party contractors. e. Vacation Preparation: Peaks Luxury Home Management will prepare the property for the client’s vacation, but the client is responsible for providing accurate information on their preferences and requirements. f. Activity Planning: Peaks Luxury Home Management will assist in planning and confirming the availability of chosen activities, but the client is responsible for any associated costs. g. HOA Management: Peaks Luxury Home Management will liaise with the HOA on the client’s behalf but is not liable for decisions or actions taken by the HOA. Peaks Luxury Home Management acts as a liaison between the homeowner and the HOA but is not responsible for decisions or actions taken by the HOA h. Home Cleaning: Our team ensures your home is sparkling clean and welcoming for your arrival. While every effort is made to maintain the highest standards of cleanliness, please note that our cleaning services are subject to reasonable wear and tear between cleanings. i. Vehicle Delivery Service: We will drop your vehicle off at the airport prior to your arrival, ensuring a seamless transition to your destination. Please be aware that any delays or issues arising from external factors such as traffic or unforeseen circumstances are beyond our control. Photos will be taken of any blemishes in the current vehicle, if any concerns arise about our level of care. j. Private Aviation: Committed to Excellence in arranging private aviation services for your convenience and comfort. Please note that while we strive to ensure a smooth experience, Peaks Luxury Home Management is not liable for any disruptions, cancellations, or changes made by the private aviation service providers. k. Vacation Preparation: Let us stock your fridge, pantry, wine cellar, and set your home to a comfortable temperature before you arrive. While we endeavor to meet your preferences, any specific requests or changes must be communicated in advance. l. Driver Services: Please note that driver availability may vary, and advanced booking is recommended for optimal service. m. Catering or Private Chef: Any dietary restrictions or preferences must be communicated in advance. n. Itinerary Creation: While we strive to create an enjoyable itinerary, activities and availability may be subject to change based on external factors. o. Grocery & Beverage Delivery: Please ensure that someone is available to receive the delivery at the designated time or provide the door code so the delivery agent can place the perishable foods in the fridge. p. Restaurant Reservations: While we make every effort to accommodate your preferences, restaurant availability may vary. q. Sending & Receiving Packages: Please note that any charges or fees incurred for sending or receiving packages are the responsibility of the homeowner. r. Equipment rental: Any gear you need to adventure, we can arrange it, have it fitted, and returned when you’re done, ensuring you have the right equipment for your activities. Rental terms and conditions apply, and any damages or losses are the responsibility of the renter. Dispute Resolution: In the event of a dispute, both parties agree to engage in good faith negotiations to resolve the matter. If resolution cannot be achieved, arbitration or legal action may be pursued, as outlined in the agreement. Governing Law: This contract is governed by the laws of Morgan County. Any legal actions arising from this agreement shall be conducted in the appropriate jurisdiction. Amendments: Amendments to this contract must be made in writing and agreed upon by both parties. No oral agreements or modifications are considered binding. Non-Payment Liability: Peaks Luxury Home Management shall not be held liable in the event that tenants fail to make payments on time. It is the homeowner's responsibility to ensure timely collection of rental payments from tenants. Peaks Luxury Home Management will provide assistance and reminders as outlined in the service agreement, but ultimate responsibility for rent collection rests with the homeowner. By signing below, both parties acknowledge acceptance of these terms and conditions. AirBNB & VRBO Vacation Rental Services: For clients utilizing AirBNB and/or VRBO services, Peaks Luxury Home Management may assist in managing bookings, guest communications, and property preparations. However, any payments received through these platforms will be directed to the client's account directly. Peaks Luxury Home Management will not be held liable for any issues arising from guest payments, including but not limited to late payments or non-payments.
